Senator Cornyn: Obama Bypassing Congress on Debt Limit is 'Crazy Talk'

Sen. John Cornyn warned President Obama on Sunday to not even consider interpreting the Constitution's Fourteenth Amendment to bypass Congress and raise the debt limit without its approval. 

"That's crazy talk. It's not acceptable for Congress and the president not to do their job and to say somehow the president has the authority then to basically do this by himself," Cornyn, R-Texas, a former judge on the Texas Supreme Court, told "Fox News Sunday." 

The proposal that Obama re-interpret Section 4 of the Fourteenth Amendment to justify raising the $14.3 trillion debt limit has been gaining traction in Democratic circles since Treasury Secretary Tim Geithner told reporters that the Constitution's language could support the president's raising the limit without congressional approval.

'The validity of the public debt of the United States, authorized by law, including debts incurred for the payments of pension and bounties for services in suppressing insurrection or rebellion' -- this is the important thing -- 'shall not be questioned,' " Geithner read during a discussion hosted by Politico in May.

Sen. Charles Schumer, D-N.Y., and others on Capitol Hill reportedly acknowledged that the idea is percolating, and had been presented to the president. 

"It's certainly worth exploring. I think it needs a little more exploration and study," he said during a conference call with reporters held Friday.

Without addressing efforts to invoke the Constitution, Sen. Jeff Sessions, R-Ala., said Sunday the president and congressional negotiators shouldn't even be discussing a debt deal privately.

"Congress is the constitutional place for this to be decided," said Sessions, who is the ranking member of the Senate Budget Committee. 

Asked during a press conference Wednesday whether the debt limit was constitutional, the president glossed over the question, saying, "I'm not a Supreme Court justice, so I'm not going to put my constitutional law professor hat on here."

Also check down at the bottom of the page at congress.org and write to other Congressional members. This is NOT right, NOT legal and goes completely against the separation of powers, their oath of office to support and defend the U.S. Constitution and is clearly a abuse of power issue. These Democratic Progressive Liberals are drunk with power and have gone rabid to hold on to it.

 

The Constitution grants Congress the power to borrow money on the credit of the United States, not the president (Article I, section 8).  Also, look at what the rest of the 14th Amendment says:

 

"4. The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned. But neither the United States nor any State shall assume or pay any debt or obligation incurred in aid of insurrection or rebellion against the United States, or any claim for the loss or emancipation of any slave; but all such debts, obligations and claims shall be held illegal and void.

5. The Congress shall have power to enforce, by appropriate legislation, the provisions of this article."  

 

It looks like 1st off, the public debt of the United States to be unquestioned would have to be "authorized by law" (the law has a debt ceiling currently).  2nd, it clearly states that "Congress shall have the power to enforce" the provisions of the 14th Amendment.  

 

Of course, it wouldn't surprise me one bit if Obama tries to skirt the Constitution some more (since he does it as often as possible).

 

What can the house do if Obama and the Democrats ignore the Constitution? 

 

First, all states with Democrat Senators must recall their Senator and contact each Republican member and tell him not to fund government if Obama and the Democrats do this unconstitutional debt raising.

 

When the Senate get enough GOP member they can impeach Obama and bring treason charges against him and any other Democrat Senators that helped him commit these crimes.

 

If we really want change it must start in the states so get busy and recall the Democrat Senators and any Republican Senators that side with the Democrats.  They the Republicans can bring charges against these criminals.

 

The AMERICAN PEOPLE need to rise up, speak up and stand up for TRUTH and HONOR.

As far as the group in Washington goes.  Most of them have been there too long, and they are truly not living in the real world where the rest of us live in the mess they have created and seem to want to make worse by not doing their jobs.  They don't listen and they do not respond to the wishes of the people any longer and haven't in quite a while.  The new people who were elected last November are still giving it their best shot, but there aren't enough of them, and Obama is not controllable and must be removed.  If the media was doing their job and reporting the real news, there would be few people who would not understand why he should be removed and most would be calling for his removal, but the media is a co-conspirator in all that has and is happening.

I didn't see anything different.  She is blaming her father which was what they did the first day of the trial.  Whole family is dysfunctional and wow, who do you believe about anything.  It's like walking on sifting sand.  I will be shocked no matter what the jury decides, won't you.  Neither side did a good job of proving their case, and a beautiful little girl is dead.  Shameful.

Actually on the Anthony case today, it has all been new, they should of held court yesterday and the jury would be adjourned for the decision by now. I really feel for those people. After today, i would want to go to my room and completely ZONE ouT.

If you notice ALL of this with Obama, always happens on a weekend, usually a holiday... when people are busy with their families and other things and are not paying attention and the news media helps him along by not reporting it.

Just as Reid and Pelosi ALWAYS held the house and the Senate over big holidays forcing a major vote. Reid called for the Senate to recess back on Tuesday the 5th, i am really surprised he did not hold them over the weekend and Monday on the fourth. Princess Pelosi had a hissy fiT over not being included in the budget talks, somehow she thinks she can change it all.

Just listened to VP Biden tell educators unions in Nevada, (last week he made the statement that IF you vote for a Republican, i will NOT help your union! How in the heck is HE gonna know who voted for who?), that the Republican party is not your daddy's old Republican party, it has completely changed and has different views and values... well hoT DaMN... he forgot to tell them, the Democratic party is not your daddy's OLe' Democratic party because WE the Progressive Liberals destroyed in 2010!!! *G* WE ARE NOW THE DSP... Democratic Socialist Party... or should we say DMP Democratic Marxist ParTy?

JL, what you suggest is wonderful, but the media isn't covering anything.  This weekend apparently all of them went off for the holiday weekend, and we are once again watching re-runs for the Anthony case............all new for me as we didn't watch it the first time around and heard enough hit and miss to know what a disaster the trial was. 

 

We don't have a press that is interested in doing anything but helping Obama destroy us!

The house must defund the government period. Running without a budget for over 795 days, in my opinion is treason, Pelosi and Reid should both be brought up on charges. There is absolutely NO accounting for money being spent by the government. The American people need to demand it from their representatives in Congress. Everything Obama is doing is planned, it is NO mistake, he is running our economy and US Debt into the ground period. We are involved in over six wars now, with drones attacking Yemen, Somali and one other country. No one is saying a THING about that. The war tab is doubling by the billions daily. We do have fighter jets dropping bombs our military is engaged in many other countries besides Iraq, Afghanistan. We need to get the movement here in this country really growing and arm people with the TRUTH.

I saw the article today about it JL.  He is the worst thing that happened to our country ever.  He really has, at least in my mind, committed treason.  He has weakened our country to the point where we may not be able to defend ourselves.  Did you also see the article where the president of Iran is trying to rush us getting out of the middle east and actually told Obama via the article to go home and deal with your domestic issues.  We are where we are because of him, and I am not sure he knows or wants to fix the problem.  He certainly isn't going to change a thing he does except he will spend every dime he can get his hands on and we can't take another year and a half of that.............and mostly it will go to trying to get himself re-elected anyway.

Guess who will buying Canada's oil after the millions, possibly billions of dollars invested in studies, time, and building of the pipeline gone to waste?
