Senator Cornyn: Obama Bypassing Congress on Debt Limit is 'Crazy Talk'

Sen. John Cornyn warned President Obama on Sunday to not even consider interpreting the Constitution's Fourteenth Amendment to bypass Congress and raise the debt limit without its approval. 

"That's crazy talk. It's not acceptable for Congress and the president not to do their job and to say somehow the president has the authority then to basically do this by himself," Cornyn, R-Texas, a former judge on the Texas Supreme Court, told "Fox News Sunday." 

The proposal that Obama re-interpret Section 4 of the Fourteenth Amendment to justify raising the $14.3 trillion debt limit has been gaining traction in Democratic circles since Treasury Secretary Tim Geithner told reporters that the Constitution's language could support the president's raising the limit without congressional approval.

'The validity of the public debt of the United States, authorized by law, including debts incurred for the payments of pension and bounties for services in suppressing insurrection or rebellion' -- this is the important thing -- 'shall not be questioned,' " Geithner read during a discussion hosted by Politico in May.

Sen. Charles Schumer, D-N.Y., and others on Capitol Hill reportedly acknowledged that the idea is percolating, and had been presented to the president. 

"It's certainly worth exploring. I think it needs a little more exploration and study," he said during a conference call with reporters held Friday.

Without addressing efforts to invoke the Constitution, Sen. Jeff Sessions, R-Ala., said Sunday the president and congressional negotiators shouldn't even be discussing a debt deal privately.

"Congress is the constitutional place for this to be decided," said Sessions, who is the ranking member of the Senate Budget Committee. 

Asked during a press conference Wednesday whether the debt limit was constitutional, the president glossed over the question, saying, "I'm not a Supreme Court justice, so I'm not going to put my constitutional law professor hat on here."

The AMERICAN people should be OUTRAGED and APPALLED.

 

Write your Congressional members ALL of them at: congress.org and Speaker Boehner at speaker.gov

 

Also check down at the bottom of the page at congress.org and write to other Congressional members. This is NOT right, NOT legal and goes completely against the separation of powers, their oath of office to support and defend the U.S. Constitution and is clearly a abuse of power issue. These Democratic Progressive Liberals are drunk with power and have gone rabid to hold on to it.

 

The Constitution grants Congress the power to borrow money on the credit of the United States, not the president (Article I, section 8).  Also, look at what the rest of the 14th Amendment says:

 

"4. The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned. But neither the United States nor any State shall assume or pay any debt or obligation incurred in aid of insurrection or rebellion against the United States, or any claim for the loss or emancipation of any slave; but all such debts, obligations and claims shall be held illegal and void.

5. The Congress shall have power to enforce, by appropriate legislation, the provisions of this article."  

 

It looks like 1st off, the public debt of the United States to be unquestioned would have to be "authorized by law" (the law has a debt ceiling currently).  2nd, it clearly states that "Congress shall have the power to enforce" the provisions of the 14th Amendment.  

 

Of course, it wouldn't surprise me one bit if Obama tries to skirt the Constitution some more (since he does it as often as possible).

 

What can the house do if Obama and the Democrats ignore the Constitution? 

 

First, all states with Democrat Senators must recall their Senator and contact each Republican member and tell him not to fund government if Obama and the Democrats do this unconstitutional debt raising.

 

When the Senate get enough GOP member they can impeach Obama and bring treason charges against him and any other Democrat Senators that helped him commit these crimes.

 

If we really want change it must start in the states so get busy and recall the Democrat Senators and any Republican Senators that side with the Democrats.  They the Republicans can bring charges against these criminals.

 

The AMERICAN PEOPLE need to rise up, speak up and stand up for TRUTH and HONOR.

Roma, thought I would pop in for a few minutes before I go finish doing my laundry and getting ready to rock and roll in the morning.  I drive up to Charleston as it isn't a far drive, and my brother lives in a place called Hollywood which is this side of the city.  It's a relatively easy drive and once I get on 17 and drive up through low country, even though it's still a ways, it feels like I have arrived :).

Great words Roma, but the problem is the things you speak about had to be addressed when they happened as the things that Obama has done would have to have been.  Once the congress lets it slide, it sets a president the next president will use in a heart beat.  So now, we need to get them to pass laws disallowing the president to do any of these things and tightening the rein up.  Unfortunately, many of the folks in Washington right now are not going to stand up to him but rather are waiting for him to get voted out and then, hope he will leave without a fight.  Then, the next group can come in and although they always say they will fix things, they generally only manage the mess left behind (which is a problem and has been every time we switch from the democrats back to the republicans if that is what we do this time).  They say they will cut the size of government and get rid of departments etc., but they never do.  Maybe Bachmann would if she gets the nod and wins the election.  We can certainly hope but she will still have to get the congress and senate to go along and she will not be like Obama so if she doesn't get approval, it probably won't happen.  We need to replace everyone that didn't get replaced last time and most especially some of those who have been there a long time and are entrenched in the Washington ways.   Other than that, if the congress ignored something and let Obama get away with it, you will have a ruff time using it.  Agree with the war powers act being unconstitutional but certainly it was never put before the supreme court for a ruling.  I don't think congress can constitutionally transfer any of their powers period........but that's me.

 

As I said earlier, I am not much of a lawsuit person and of late, it seems to be the new norm for everyone, so I will wait and see what you all decide.  In the mean time, I am off to Charleston in the AM and am about ready to pull the plug on the computer.  Will see you all on line again sometime Friday after I get back.  Who knows what you and JL could come up with between now and then.  Happy 4th of July to both you and JL!

I have a bit of a tit for tat going ont he TU with several liberals and zero conservatives over privatizing services here.  Logis is not theirs............and it never is.  If they can't win by brawn, they will lock you in a dark closet where no one can hear you while they continue their senseless rhetoric.  And yes, it is of concern she is a teacher as she probably treats the children in her class the same way.  Liberals always know everything, you know.

 

The other thing that can be used for the second amendment is:  without a second amendment, there would be no first amendment.   We need the second amendment to protect ourselves against the likes of those who think they know best and want to tell you what and when to do period and what to think and say.  Sooner or later, you will need a gun........actually, there was a piece on TV the other day, and the one comment made in relation to the Wyoming part of the documentary was folks from Wyoming have both hand guns and rifles and the hand gun is what you use until you can get back to where your rifle is.  Guns are huge in Wyoming as it is the state that is most like the old west than pretty much any other state.  They also did Texas and they have their own power grid and therefore are exempt from many of the EPA rules related to power grids.  Interesting documentary about several states.

Note here, i had a disagreement with a liberal in a group that i have belonged to for several years, she was wanting a discussion on WHY is the second amendment still applicable? We have a paid military so why do we need the right to bear arms? Perhaps the founding fathers left room for hunters?

 

I wrote my thoughts and she banned me from the discussion because I DID NOT AGREE WITH HER. She did not allow my statement that in Switzerland when you become 15 years old you are issued several weapons, munitions and trained how to use them, there are targets all along the roadside and every citizen is part of the militia because they do not have a military. Their crime rate is almost non-existant because all citizens are bearing arms.

 

I also wrote that Founding Fathers were not even considering hunters because everyone hunted for food back then. There was no police force so people armed themselves to protect their families and communities. She blocked all of my replies and she commented: "JL, please prove your statement... we need facts not anecdotes." She then ended the discussion. 

 

Thank goodness many emailed me and i redid what i was trying to post, i posted over six lengthy posts that kept not being posted, i have NEVER had that happen before so like a mad man i was frantically typing words and posting. I found out later that she has done this before if you did not agree with her and many are not going to be involved in a one sided discussion again with her.

 

This is the ignorance that is happening all around the country, a friend of hers, a teacher from Wisconsin in the public school system stated that my comment offended her for supporting the 2nd Amendment, that she has seen guns over and over destroy lives and kill people, they should be banned period. 

 

She also stated the 2nd Amendment used poor grammer ? Many wrote me and stated, THIS woman is in our public education system teaching our youth? Has anyone told her people killed people? If you took her logic, then cars, skateboards, baseballs, baseball bats, footballs, boats, scooters, food, buses, almost everything would be banned period.

Obama has already said we need to consider a re-write, but that is the attitude of most liberals.  They want to be able to steal other people's property etc.  They really want to put us right back where we were with England and also see nothing wrong with their stance (since it would give them almost unstoppable power).  Be grateful we still have a supreme court that is moving back over to the right with each and every recent ruling.  You also need to understand that Obama, in spite of the fact he has taken some steps we do not favor, has yet to violate the constitution.  He has been careful to go right to the edge which is what he meant by congress going up against a constitutional professor (he should wish.......he was probably more like an instructor).  He uses parts of the constitution for which their are presidents, and my hope is the court will see those presidents must be over turned if our republic is to be saved from the likes of the Obamas of this world.  What Obama did was study the constitution with an eye to breaking it and over throwing our form of government, so in any real sense, he is totally evil!  As I said, I will wait this one out without too much comment, and see what you come up with.  You still need a reason for a lawsuit and a group who are damaged by the action you sue for (not an easy feat).

Patricia, unfortunately to do anything in the legal system, you must bring up a lawsuit. Personally i think there are way too, many lawsuits also but how do you stop elected representatives from making decisions that affect your everyday life and they do NOT listen to their constituents? It is clear by their voting record the direction Nelson is moving in and very disappointing to see Crenshaw is moving in. They are clearly supporting the Progressive Liberals and ignoring the U.S. Constitution.

I'm ordinarily a fan of AlterNet, but this article took more logic twists than a teabagger on meth. So what if misguided TeaParty and other conservatives use the constitution for everything from how to tax, to which white socks look best with their sandals. (Many subvert the bible as a given authority to mandate whatever they wish, also.) Using The Constitution is a common rhetoric technique. If more Americans understood The Constitution and the thoughtful intent of the Founding Fathers they'd laugh at such notions. History revisionists are a persistent pain, but the only way to fight the absurdity is with knowledge. 

In the "ocean of idea" there are omnipresent FISH. 

The article is way too dismissive of the wisdom behind The Constitution and The Bill of Rights. Yes, the writers then might be shocked by modern technology, so is my grandmother, but they wouldn't be surprised by how much we need to understand and enforce the rights they fought about and for. 

They would never believe the Supreme Court granted personhood to cooperations...to long a list. 

Just become some bs'ing baggers misuse the Constitution doesn't lessen its value. 

 

Don't take my word for it. Take a couple of hours and read it for yourself.

Surely the constitution and the bill of rights need a re-write? - They were written a long time ago. The right to carry a gun had some meaning then, not any more.

Personally i think that is the direction that the Progressive Liberals will try to take it all, to rewrite the U.S. Constitution and Bill of Rights, they are going to be nudging our country towards a Constitution Convention for the whole country. 

 

Instead of sitting quietly we need to move and examine our options before it is too, late. I am very disappointed with what the old guard of Congress on the GOP/Conservative side has done. They have the tools, Pelosi is no longer at the helm, they can do many things to stop what is going on in Congress and this administration but are not. It is all very disturbing. I am fed up with empty words and false promises. If we all wait to long to jump in, it may end up being too, late period.

 

Just my thoughts...

Roma, I am not ignoring the blog.  I just am not weighing in just yet as I am not much of a law suit person and think there are far too many of them already.  My concern is the word lawsuit is being used before a reason for the suit or even figuring our how anyone was damaged.  Don't get me wrong, I am not against what you say, I just think we are lawsuit happy in this country and want to see what you guys come up with before I say anything.  We certainly, in our lives, have had times when we could have chosen that path, but decided on an alternate course instead.  I am thinking of another approach to the Crenshaw and Nelson issue, but will think on it before I jump into it.

Roma, that is so true, the citizens are the government because we govern ourselves as outlined in the U.S. Constitution which our elected leaders have sworn an oath to the people to support and defend. Right now we could recall Crenshaw and Nelson for breaking that oath as well as many others. 

I am still learning about it all, let me know what i can do to help. The biggest thing that i have done lately is trying to get the truth out, about our history, our Founding Fathers' Charters of Liberty and Freedom and to stamp out the lies, the miss truths etc.. I am in, let me know what i can do.
