Fighting Equal Employment Opportunity Rights for Illegal Aliens

On August 29, 2014, U.S. Equal Employment Opportunity Commission signed what is known as a “Memorandum of Understanding” (MOU) with the Mexican Ministry of Foreign Affairs that essentially guarantees equal employment rights for illegal aliens from Mexico working in the U.S. While the EEOC website states that this MOU protects immigrant and migrant workers, it also repeatedly makes reference to “other vulnerable workers” while the actual MOU document refers to “all Mexican nationals in the United States.” Furthermore, EEOC General Counsel David Lopez said outright that it applies to “even those who live and work in the shadows.”

The immediate and obvious concern is the fact that the Federal Government is using this MOU to incrementally advance so-called “immigration reform” by granting equal rights to illegal aliens. This will make it easier to pave the way for additional actions such as amnesty. The second concern is the idea that this agreement is tantamount to a federal agency signing a treaty with a foreign sovereign nation, using the memorandum of understanding tool as an end-around to treaty approval by the U.S. Senate and Congressional oversight. The legal standing of using MOU’s in this fashion is very debatable and vague at best. Establishing acceptance of such tactics is also similar to accepting the use of Presidential Executive Orders to unilaterally bypass legislative action. This MOU, therefore, has serious ramifications on several fronts.

Both houses of Congress have a respective Committee of Appropriations Subcommittee on Commerce, Justice, Science and Related Agencies which oversee budgets and spending for the EEOC. Since this MOU is loaded with new taxpayer-funded expenditures to support new programs, we need to contact the members of these subcommittees to demand that funding be blocked. This would go a long way in preventing any effective implementation of this unilateral agreement. (Individual contact is provided below)
