Police report filed on stolen Schellenberg signs April 28th; they were discovered in a retention pond behind the Bealls department store at the corner of San Jose and Orange Picker in Mandarin.  This is the SAME place the signs were found discarded during the primary elections in March.

(b)

There is established within the Department, as an autonomous component thereof, a Planning Commission (hereafter referred to as "Commission") consisting of nine members, and three alternates, appointed by the Mayor and confirmed by the Council for a term of three years. Of the nine members and three alternates, one member shall be appointed from and shall be continuously throughout his term a resident of each City Planning District, and three members and the three alternates shall be appointed at-large and shall be residents of the city during their entire terms; provided, however, that the member from the Urban Core Planning District shall be a resident of, or own a business in, that District; failure to retain these qualifications shall automatically remove the person not qualified from serving as a member or alternate . The three alternates shall either be former Planning Commission members or former City Council members who have served on the Land Use and Zoning Committee of the City Council. Members and alternates shall be appointed for three-year staggered terms (except appointments to fill vacancies). No member shall serve for more than two consecutive full terms; but appointments to fill vacancies for unexpired terms and initial appointments under the preceding sentence for less than three years shall not be deemed to be full terms. A member or alternate may be removed by the Mayor during his term, with the approval of the Council. A vacancy shall be filled in the same manner as the original appointment, for the unexpired term. Members shall serve without compensation, but shall be entitled to travel expense reimbursement in accordance with Part 7, Chapter 106. The provisions of F.S. § 286.012, as amended from time to time, shall apply to each member and alternate of the Commission.

The question I have after doing this digging, is this not a conflict of interest. Hemmerly works in property development and construction and also is on a board that has an input as to where development and construction occurs.  On the other hand, I am not a lawyer, just an everyday citizen tired of the "Good Ole Boys Clubs" across the nation.

An individual on the Planning Commission has a multitude of authority and decision making power.  

 

 

Sec. 30.204. - Functions.

The Commission shall:

(a)

Review proposed land use changes, text changes to the Comprehensive Plan, requests for exceptions, variances and waivers to the Zoning Code (except those pertaining to properties located within the Downtown Overlay Zone, as defined in Section 656.361.2), appeals from written orders granting or denying an administrative deviation and written interpretations of the Zoning Code and final orders of the Cell Tower Review Committee and other matters related to land use and area planning which are referred to the Department or to the Commission pursuant to law.

(b)

Review and make recommendations to the Council on proposed changes to the Zoning Code, the Code of Subdivision Regulations and other land development regulations or amendments thereto, and with respect to all rezonings, except rezonings of properties located within the Downtown Overlay Zone, as defined in Section 656.361.2).

(c)

Review and make recommendations on plans and programs developed by the Department (excluding project planning) prior to transmittal to the Mayor or independent agency, as the case may be.

(d)

Serve as the local planning agency required pursuant to F.S. § 163.3174, and prepare the comprehensive plan or plan amendment after hearings to be held after public notice and make recommendations to the City Council regarding the adoption or amendment of the comprehensive plan.

(e)

Monitor and oversee the effectiveness of the status of the comprehensive plan and recommend to the Council such changes in the comprehensive plan as may from time to time be required, including the preparation of periodic reports required by F.S. § 163.3191.

(f)

Review and assign planning priorities under Part 6, Chapter 122 and perform the reviews required by Sections 122.606 and 122.609.

(g)

Review and assign planning priorities under Chapter 748 and perform the reviews required by Sections 748.202 and 122.609.

(h)

Review and make recommendations on plans prepared pursuant to state and federal requirements or regulations.

(i)

Act as a coordinating agency for programs and activities of executive agencies and independent agencies affecting land use and area planning, when requested to do so by the Mayor or the Director.

(j)

Review appeals of Written Interpretations rendered by the Director pursuant to Section 656.109, Ordinance Code, and conditions of site plan approvals imposed by the Department pursuant to Section 656.404, Ordinance Code.

Great post, Jenna!  I wonder if Flagler Construction Equipment, Inc.'s home office officials are aware that Tony Hemmerly, their Territory Manager for the Jacksonville area, will possibly be charged---on the basis of witness evidence, with taking and discarding signs that are the property of Matt Schellenberg, a Republican candidate for Jacksonville City Council, who had permission from Sleiman Industries to place his election signs on their properties. 

Mr. Tony Hemmerly, a member of the Jacksonville Planning Commission, is a close friend and ally of Jack Webb, Jacksonville City Council President, who is running against Matt Schellenberg for election to a seat on the Jacksonville City Council.  Mr. Hemmerly is often seen in the company of Jack Webb and he is one of the men who acosted Debbie Gonzalez while she was displaying a sign urging voters to vote for Matt Schellenberg.  Debbie was harassed, intimidated, bullied and coerced to stop her campaign activity and to leave the site where she was exercising her First Amendment rights.

To me, such actions demonstrate dishonesty and unethical behaviors on the part of those male bullies who were cowardly enough to act in the manner they did. And, from what I read earlier, it appears that they were not truthful with the JSO officer who was called to the scene to investigate the incident against Debbie.  Since that time, Matt Schellenberg's signs have been removed approximately four times... and Debbie reported there was a witness to the latest incident. 

Below is a link to a search results page with information about Flagler Construction Equipment, LLC, which is a huge corporation with an out of state corporate headquarters. With the construction business down, especially in Florida, and the Florida unemployment rate being higher than average for the country, they can't be happy with any bad publicity caused by one of their territory managers.

Let's see, nominated by the millage raising Peyton, approved by "Stickey Fingers Jack Webb", a regional manager for Flagler Construction, a company that builds, ummm, err, Planning Commission approved, infrastructure (can you say "Stimulus?").  You know stealing signs is the least he can do to protect his Jack Booted Bwanas.
