Gun Rights Legislation stuck in Judiciary Committee


SB 68 Campus Carry / SB 300 Open Carry

SB 68 reads:

"Licenses to Carry Concealed Weapons or Firearms; Deleting a provision prohibiting concealed carry licensees from openly carrying a handgun or carrying a concealed weapon or firearm into a college or university facility, etc.

SB 300 reads: 

"Weapons and Firearms; Providing for construction of statutes that implicate the right to bear arms or engage in self-defense; specifying that a law enforcement officer may arrest a person for the unlicensed carrying of a concealed weapon only upon probable cause that such a violation is being committed; providing that a person licensed to carry a concealed firearm or weapon may also openly carry such firearm or weapon as long as such person is in compliance with specified provisions; providing that a person or entity who infringes on specified rights of an individual may be subject to liability under specified provisions, etc."


SB 68 by Senator Greg Evers “Campus Carry” deletes a provision prohibiting concealed carry licensees from openly carrying a handgun or carrying a concealed weapon or firearm into a college or university facility.
SB 300 by Senator Don Gaetz “Open Carry” provides that a person licensed to carry a concealed firearm or weapon may also openly carry such firearm or weapon.
Like the late Yogi Berra said; “it is deja vu all over again”. In the last legislative Session, the campus carry bill (HB 4005) was moving through the House and had passed all House committees. The Senate campus carry bill (SB 176) had passed two Senate committees. Things were looking good, until the Senate bill landed in the Senate Judiciary committee chaired by Senator Miguel Diaz de la Portilla.


Unfortunately, Senator Miguel Diaz de la Portilla would not place the bill on the committee agenda and the bill died.


So here we go again, the new campus carry bill (HB 4001) has passed all committee stops and now is ready to be voted on by the full House in January. The Senate Campus Carry bill (SB 68) has already passed two Senate committees and now sits in Senator Miguel Diaz de la Portilla’s Judiciary committee.

HB 4001 reads:

"Removes provision prohibiting concealed carry licensees from openly carrying handgun or carrying concealed weapon or firearm into college or university facility."

In addition, SB 300, the “Open Carry” bill has also stalled in Portilla's Senate Judiciary Committee. In fact, both SB 68 and SB 300 were sent to the Judiciary Committee the third week of October. Senator Miguel Diaz de la Portilla has had almost six weeks to put these bills on his Committee agenda. What gives?


Obviously Senator Miguel Diaz de la Portilla is not concerned with your 2nd Amendment rights and your natural right to defend your life, liberty and property.
We need to let Senator Miguel Diaz de la Portilla know in no uncertain terms that we want both SB 68 and SB 300 be put on the next Judiciary Committee agenda. Our right to self-defense should not be used for political games.

Call State Senator Miguel Diaz de la Portilla's office in Tallahassee and let him know that these bills need to be put on the agenda for the Senate Judiciary Committee to vote on.

the latest on the latest House Bill 163 regarding Florida Open Carry. They just crammed in a bad amendment into this bill regarding a "place of nuisance";

I just read the filed amendment regarding "the place of nuisance" and one addition MUST be added regarding a place of nuisance as defined in s. 823.05. A "place of nuisance" relates to gang activity and such illegal related activities.
A law abiding citizen wishing to carry for lawful self defense MUST be exempt from this restriction even if they are within the "place of nuisance" provided they have a legal right to be there. This is consistent with Florida Law. Banning a person from carrying within a place of nuisance, provided they are not contributing in criminal activities, would not be consistent with a person's right to self defense under the second amendment as well as Florida's laws pertaining to a "legal right to be" clause. A property owner, for example, wishing to protect themselves from criminal activities, gangs, or contributors that cause a "place of nuisance" to exist in the first place, would need such protections.
       

THE AMENDMENT READS:

Between lines 104 and 105, insert: 4

Section 5. Paragraph (a) of subsection (12) of section 5 790.06, Florida Statutes, is amended to read: 6

790.06 License to carry concealed weapon or firearm.— 7

(12)(a) A license issued under this section does not 8 authorize any person to openly carry a handgun or carry a 9 concealed weapon or firearm into: 10

1. Any place of nuisance as defined in s. 823.05; 11

2. Any police, sheriff, or highway patrol station; 12

3. Any detention facility, prison, or jail; 13

4. Any courthouse;
